Unemployment benefit for the cessation of activity of the self-employed.

If you are self-employed and your activity is included among those detailed in the Appendixto Royal Decree 463/2020, of March 14th, which declares the state of emergency for the management of the health crisis caused by COVID- 19, you can take advantage of the aid approved by the government, consisting of an unemployment benefit for the cessation of activity. These are the activities included in the Royal Decree:

APPENDIX ROYAL DECREE-LAW:

Validity of the unemployment benefit caused by the cessation of activity.

The validity of the same is limited to one month, from March 14th, 2020, or until the last day of the month in which the state of emergency ends, if it continues for more than a month. With the latest news received, this situation could last until at least April 11th 2020.

Who is entitled to receive this unemployment benefit?

All the self-employed whose activity is included among those included in the APPENDIX that you can download above and also all those recently added self-employed hairdessers.

If your activity is not included in the Appendix, BUT your income during the month prior to which you want to apply for the unemployment benefit has been reduced by at least 75% in relation to the average income for the previous semester, you can also request this unemployment benefit.

What requirements do I have to meet in order to apply for the unemployment benefit?

First, you must have been affiliated and registered in the Special Social Security Regime for Self-Employers, on the date of declaration of the state of emergency, that is, on March 14th 2020.

If your activity is not included in the Apendix above, you must prove the reduction in your income by at least 75% in relation to the average billing for the previous semester.

If you are receiving any other type of benefit from the Social Security system, you will not be able to apply for this unemployment benefit.

If you are paying the reduced contribution within the Social Security “flat rate” program, you can apply for this unemployment benefit.

Second, you must be up to date with the payment of your Social Security contributions. If this requirement has not been met, you have time to voluntarily rectify this situation within 30 days and thus be able to access the right to receive the unemployment benefit.

What will be the unemployment amount of benefit be?

As long as you have contributed for the minimum contribution period to be entitled to the unemployment benefit, it will consist of 70% of the regulatory base. This benefit is estimated to be around 700 euros.

If you have not contributed for the minimum period to be entitled to the unemployment benefit, the amount of the benefit will be equivalent to 70% of the minimum base.

How long could I receive the benefit?

The duration of the unemployment benefit will be one month and may be extended until the last day of the month in which the state of emergency ends, in the event that it is extended and lasts more than one month. For the moment, the state of emergency has been extended until April 11th, 2020. During the time the self-employer is receiving this unemployment benefit it will be understood as the self-employed has been contributing to Social Security and will not reduce the periods of unemployment benefit for cessation of activity to which the beneficiary may be entitled in the future.

What documentation do I have to process?

1.            CATA COVID-19 application form.

2.            Sworn declaration.

3.            Copy of your NIE

4.            Form 145 completed.

5. Bank certificate of account or any other document proving that you are the owner of the account where you want to receive the benefit.

6.            When the request for the unemployment benefit is motivated by the reduction in income by at least 75%, it will be necessary to provide a communication accrediting said reduction.
